Online purchase conditions
All purchases made through the portal https://hearsafe.es/en/ (hereinafter, the Website), owned by AUDIAS SL, are subject to these general conditions for online purchases.
By purchasing on the website, you automatically accept these conditions. Please read them carefully.
The purchase of any of the products implies full and unreserved acceptance of each and every one of these general conditions, without prejudice to the acceptance of the specific conditions that may be applicable to the purchase of certain services/products.
AUDIAS SL is empowered to unilaterally modify each and every one of the obligations set out in these conditions without prior notice, with the proviso that this power of modification cannot affect contracts that are in force at that time.
The Website does not require prior subscription for simple browsing, access or use of the service in question. On the other hand, for access to certain content, prior subscription and the corresponding registration as a User (hereinafter referred to as a Registered User) will be required.
User registration
In accordance with the above, AUDIAS SL reserves some of the Services offered through the Website for Registered Users.
In order to purchase from the AUDIAS SL online shop, you must register with AUDIAS SL. Your data will be saved and your future purchases will be faster. To register and buy in the online shop you must go to the "New customer" section in the "Login" section. If you are already registered to buy in the online shop and you have forgotten your password, you must go to the "Login" section, click on the option "Forgot your password?" and insert your e-mail address and "Send password reset link", and you will immediately receive an e-mail with your password.
The User undertakes to select, use and keep his/her user name or "login" and password (hereinafter and jointly the "Access Keys") in accordance with the provisions of the following clauses.
Assignment of the Access Keys
The User shall have the option to choose and indicate his or her own Access Password. The User will not be able to choose the User Name in any other way than being a valid e-mail address, through which he/she will communicate with AUDIAS SL.
Use and Custody
The User undertakes to make lawful and diligent use of the Access Password and not to make his/her Access Password available to third parties.
The User undertakes to inform the Webmaster of AUDIAS SL as soon as possible of the loss or theft of the Access Codes, as well as any risk of access to them by a third party.
The Access Password may only be used by the Users to whom it has been assigned. AUDIAS SL is exonerated from any type of responsibility that may arise from damages caused or suffered due to fraudulent use or lack of diligence in the safekeeping and custody of the Access Key, loss or use in contravention of the provisions of these Conditions.
User cancellation
At any time you can request cancellation as a Registered User by sending an email to hearsafe@hearsafe.es giving details of the user to be cancelled.

The information provided by AUDIAS SL to the consumer or user about the products offered will be in accordance with the essential characteristics of the good or service being purchased. AUDIAS SL will keep the prices of the products updated by being in permanent contact with the suppliers and manufacturers.
AUDIAS SL declares that the product offered corresponds to the technical description and essential characteristics of the same. However, it is made clear that, as far as the photographs are concerned, these are merely for guidance purposes and there may be variations in their physical appearance, but without undermining the integrity and performance of the product requested.

Shipping
AUDIAS SL will not send any product until the Administration Department has verified that payment has been made.
Delivery shall be considered to have been made when the carrier has made the products available to the client and the client has signed the delivery receipt document. It is the customer's responsibility to check the products on receipt and to state any reservations and complaints that may be justified in the delivery receipt document.
AUDIAS SL will send the products by the means it deems appropriate to fulfil its commitments.
If for reasons of incomplete, incorrect or absent address in several delivery attempts, the goods are returned or have to be sent again to another address, the "rechanneling" must be paid by the customer.
Shipping costs
Shipping is free for all our products with the exception of accessories or products with a price range of less than 60 €.
AUDIAS SL RESERVES THE RIGHT TO REQUEST AN ADDITIONAL AMOUNT for particularly heavy or bulky orders. If this happens and the customer is not interested in formalising the order with the indicated shipping costs, the amount paid will be refunded and the order will be cancelled. AUDIAS SL will be exempt from any other commitment or obligation to the customer.
Delivery time
The delivery time to the delivery address is 7 to 14 working days for accessories and standard or universal products.
For made-to-measure products, the delivery date of your ear impressions will be taken into account and from then on we have a maximum of 30 days.
However, these deadlines are approximate and may vary for reasons beyond our company's control. AUDIAS SL does not commit itself to any specific delivery time, as the shipping process depends on third parties.
Stock out of stock
On the website we only offer for sale products in stock, either in our own warehouse or in the warehouse of an entity, manufacturer or wholesaler, which allows us to serve the product within the time described as delivery time. AUDIAS SL will, whenever possible, make use of all necessary means to keep the website synchronised with the warehouses and offer the products that are available at any given time.
When it is not possible to supply a product due to lack of stock, AUDIAS SL will contact the customer to inform them, cancel the order and return their money immediately by bank transfer. In these cases, the amount will always be refunded to the customer and the order will be cancelled. IT WILL NOT BE POSSIBLE TO KEEP THE PRICE OF THE PRODUCT OUT OF STOCK TO SERVE IT WHEN THE STOCK IS REPLENISHED, since the price of the product changes in each replenishment according to our purchase price.
Guarantees
Legal guarantee
In the case of a contract for the sale of goods or the supply of digital content or services supplied in a single act or in a series of individual acts, the entrepreneur shall be liable for any lack of conformity which exists at the time of delivery or supply and which becomes apparent within three years of delivery in the case of goods or two years in the case of digital content or services. The seller's liability is exempted in cases where the consumer and user was aware of these faults at the time of conclusion of the contract.
If the good is not in conformity with the contract, in order to bring it into conformity, the consumer or user will have the right to choose between remedying the lack of conformity through repair or replacement of the good, unless one of these measures proves objectively impossible or disproportionate.
The bringing into conformity shall be deemed to be disproportionate where it imposes costs on the seller which are unreasonable, taking into account all the circumstances applicable to the case, and in particular the value of the goods without the lack of conformity, the significance of the lack of conformity and whether the alternative remedy could be provided without major inconvenience to the consumer.
Where the remedy of the lack of conformity cannot be chosen, the consumer or user shall be entitled to a reduction in the sale price or the rescission of the contract, the latter option not being applicable where the lack of conformity is minor.
The exercise of these rights by the consumer shall not entail additional costs for the consumer, being essential for its exercise the presentation of the receipt of purchase, invoice or delivery note.
Right of withdrawal and returns
The user shall have the right to withdraw from the purchase within 14 days of delivery of the goods.
Exceptions to the right of cancellation
Except for those products that are defective or incorrectly supplied, according to the provisions of article 103 of Law 3/2014, of 27 March, which amends the revised text of the General Law for the Defence of Consumers and Users, the right of withdrawal shall not apply to contracts relating to:

You should therefore be aware of the following: Most products purchased on hearsafe.co.uk can be returned, as long as they are in perfect and unused condition. Including accessories, documentation and packaging, otherwise we can not accept the return for reasons of hygiene and health.
In accordance with the above exceptions, the return of customised and/or (personalised) products will not be accepted. You can always request all the necessary corrections for its perfect functioning.
How to exercise the right of withdrawal
To exercise the right of withdrawal in respect of products purchased exclusively on the Website, you must state your unequivocal decision to withdraw from the contract, within 14 calendar days, in one of the following ways:
- If you choose the option of returning the product in any of the AUDIAS SL establishments, you must first contact our Customer Service Department on +34 981925367, who will send you a return authorisation which you will have to present in the shop.
- If you choose the option of returning the product through the online shop on the website, you can process them from the "My Account" section or contact our Customer Service Department on +34 981925367, or via the email account hearsafe@hearsafe.es to unequivocally state your decision to withdraw from the contract.
- Without prejudice to the provisions of the preceding paragraphs, you may also choose to exercise your right of withdrawal by completing and sending electronically to the email account hearsafe@hearsafe.es the withdrawal form that can be downloaded from here, in which case, we will inform you promptly by email of the receipt of such withdrawal.
The right of withdrawal shall be deemed to have been exercised within the deadline when you have sent us the communication concerning the exercise of this right before the end of the corresponding deadline, in the terms indicated above.
Consequences of withdrawal
In the event that you exercise the right of withdrawal, we will reimburse to you all payments that we have received from you, excluding delivery charges without undue delay and in any event not later than 14 calendar days from the date on which you inform us of your decision to withdraw from the contract. We will proceed to carry out such reimbursement using the same means of payment in which the purchase was paid for without you incurring any costs as a result of the reimbursement, with the exception of the costs of returning the product.
The products to be returned must be in perfect condition. If this is not the case, the cancellation cannot be exercised.

In the event that a consumer and user is involved, the parties submit, for the resolution of disputes arising from these general conditions of sale, to the Courts and Tribunals of the civil order corresponding to the domicile of the consumer, by virtue of their specific regulations.
For all other parties involved, territorial jurisdiction shall be determined by the general rules of distribution of jurisdiction, as set out in articles 50 and following of the Civil Procedure Act.
